Terms of Service

By using AgencyPitch you agree to these Terms. We've kept the legalese minimal — if anything is unclear, email us and we'll explain.

1. Who we are

AgencyPitch (“AgencyPitch”) is a global B2B software product operated by GrahAI Systems, a company registered in India. By creating an account or using AgencyPitch you agree to these Terms of Service (“Terms”).

2. Eligibility

You must be at least 16 years old and legally able to enter into a contract. You must use AgencyPitch only for lawful business purposes — creating proposals for clients you represent or have authorization to represent.

3. Your account

  • You’re responsible for keeping your password and account access secure.
  • You’re responsible for all activity under your account, including by team members you invite.
  • If you discover unauthorized access, email security@agencypitch.io immediately.
  • You may add team members up to your plan’s seat limit.

4. Acceptable use

You agree not to:

  • Use AgencyPitch to send spam, phishing, or harassing communications.
  • Generate proposals for businesses you don’t represent or have authorization to represent.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Resell, sublicense, or white-label AgencyPitch except under our Pro plan’s explicit white-label allowance.
  • Use the service to generate illegal content, hate speech, or content that violates third-party rights.
  • Probe, scan, or test the vulnerability of our systems without prior written authorization.
  • Scrape, mass-extract, or use automated tools beyond what our API permits.

Violations may result in immediate account suspension. We reserve the right to refuse service to anyone for any lawful reason.

5. Subscriptions, billing, and renewals

  • Subscriptions are billed monthly or annually in advance through Razorpay.
  • Subscriptions automatically renew unless cancelled before the renewal date. Cancel from Settings → Billing at any time.
  • Prices are in USD. We may charge applicable taxes (GST, VAT, sales tax) based on your location.
  • Annual plans include a 20% discount versus monthly. The discount is non-transferable to other accounts.
  • The free Starter tier requires no payment and remains free for as long as AgencyPitch operates.

6. AI-generated content

AgencyPitch uses third-party AI providers (Anthropic Claude, Google Gemini) to generate proposal content from your inputs. You acknowledge:

  • AI output may contain errors, omissions, or inaccuracies. Review every proposal before sending it to a client.
  • You retain full ownership of proposals you create with AgencyPitch.
  • We do not use your inputs to train AI models. AI providers may temporarily process inputs subject to their own policies.
  • AgencyPitch is not liable for losses arising from AI inaccuracies in your proposals.

7. Your content

You retain ownership of all content you upload — proposals, logos, case studies, client information. You grant us a non-exclusive license to host, process, and display your content solely to provide the service. We do not share your content with anyone other than necessary subprocessors (listed at agencypitch.io/subprocessors).

8. Service availability

We target 99.9% monthly uptime but make no formal SLA on Solo, Agency, or Pro plans. Enterprise customers can request a written SLA with credits. Planned maintenance is announced at least 48 hours in advance via email and in-app notification.

9. Termination

You can cancel anytime from Settings → Billing. We may suspend or terminate accounts that violate these Terms, with notice where reasonable. On termination, your data is retained for 30 days then permanently deleted — unless legal hold or fraud investigation requires longer retention.

10. Limitation of liability

To the maximum extent permitted by law, AgencyPitch’s total liability for any claim arising from these Terms is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 100.

We’re not liable for indirect, consequential, special, or punitive damages — including lost profits, lost data, or business interruption — even if we’ve been advised of the possibility.

11. Indemnity

You agree to indemnify AgencyPitch from third-party claims arising from your use of the service, your content, or your violation of these Terms.

12. Disclaimers

AgencyPitch is provided “as is.” We disclaim all warranties to the extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.

13. Governing law and disputes

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India, except where local consumer-protection law in your country of residence requires a different forum.

Before filing any formal claim, you agree to attempt to resolve disputes informally by emailing legal@agencypitch.io. We’ll respond within 30 days.

14. Changes to these Terms

We’ll notify active users at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
